RE: The tariff classification of a cylindrical roller bearing and cage assembly from France

Dear Ms. Koller:

In your letter dated November 20, 2009 you requested a tariff classification ruling. Descriptive literature and technical drawings were submitted.

The article you plan to import is identified as a cylindrical roller bearing and cage assembly used primarily in a gas turbine engine. It is comprised of the following parts: a cylindrical roller bearing assembly, a cylindrical steel roller and cage assembly, a flanged outer race and a gear box idler.

The cylindrical roller bearing assembly, part number 0260608160, consists of an outer race, cylindrical rollers and a bearing cage.

The cylindrical steel roller and cage assembly, part number 0260607360, includes a single row of cylindrical rollers and a copper cage to house the rollers.

The flanged outer race, part number 0260600270, works together with the cylindrical steel roller and cage assembly. The rollers are held in place by the flanged outer race and cage. You raise the question as to whether an outer race that is flanged could be considered a flanged housing. A bearing housing consists of a frame or block designed to house an otherwise complete bearing. Because the “housing” in this case is actually the outer race and completes the cylindrical roller bearing, it does not house the bearing.

The high speed gear box idler, part number 0260602860, is comprised of a gear and a transmission shaft. The gear box idler is used for the transmission of power and also functions as the inner race for the cylindrical roller bearing, part number 0260608160.

You suggest classification of the gear box idler under subheading 8483.10.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other transmission shafts and cranks or subheading 8482.99.6560, HTSUS, as parts for other cylindrical roller bearings. However, based on our review of the technical drawing you have submitted, we find that the gear box idler is more specifically provided for as parts of gearing under HTSUS subheading 8483.90.

The applicable subheading for the complete cylindrical roller bearing assembly and the cylindrical steel roller and cage assembly will be 8482.50.0000, HTSUS, which provides for other cylindrical roller bearings. The rate of duty will be 5.8 percent ad valorem.

The applicable subheading for the flanged outer race will be 8482.99.2560, HTSUS, which provides for inner or outer rings or races for other cylindrical roller bearings. The rate of duty will be 5.8 percent ad valorem.

The applicable subheading for the gear box idler will be 8483.90.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for parts of gearing, gear boxes and other speed changers. The rate of duty will be 2.5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
